All Sellers Are In-Trade Businesses

Every seller on Card Advantage is a paying subscriber using a professional inventory and marketplace management platform. All sellers operate in trade as defined by New Zealand law. This means the Consumer Guarantees Act 1993 (CGA) applies to every purchase made through the Card Advantage storefront.

You cannot be told “no refunds” or “buyer beware” — these consumer rights cannot be contracted out of by any seller.

Your Statutory Rights Under the CGA

Under the Consumer Guarantees Act 1993, every purchase from a Card Advantage seller comes with the following guarantees:

  • Acceptable quality — the card must be of a standard that a reasonable person would regard as acceptable, considering the price and description.
  • Fit for purpose — the card must be suitable for its intended use (e.g., a tournament-legal card must be genuine and playable).
  • Matches description — the card must match the listing description, including condition grade, set, variant, and any other stated attributes.
  • Delivered in acceptable time — the card must be delivered within the timeframe stated or within a reasonable time.

When You Can Return a Card

If a card fails to meet any of the CGA guarantees above, you are entitled to a remedy from the seller. The type of remedy depends on the severity of the issue:

Minor failure (e.g., slight condition discrepancy): The seller may offer to repair, replace, or refund at their discretion. The seller must cover any return shipping costs.

Major failure (e.g., counterfeit card, completely wrong item, or condition drastically different from described): You may choose a full refund or a replacement. The seller must cover return shipping costs.

Claims should be raised within 14 days of receiving the card.

Change-of-Mind Returns

Under New Zealand law, there is no statutory right to return goods for a change of mind. If you simply change your mind about a purchase, the seller is not obligated to accept a return or issue a refund. However, some sellers may offer voluntary change-of-mind returns — check the individual listing or contact the seller to confirm.

How to Request a Return

  1. Contact the seller— Use the card seller’s contact details or email them directly. Explain the issue clearly and provide photos if relevant.
  2. Allow 5 business days — Give the seller a reasonable opportunity to respond and propose a remedy.
  3. Contact Card Advantage — If the seller does not respond or you cannot reach a resolution, email support@cardadvantage.cc and we will assist in facilitating communication.

Card Advantage’s Role

Card Advantage is a digital marketplace platform, not a party to any transaction. We provide the technology that connects buyers and sellers. While we are not legally responsible for the quality or delivery of goods, we take the integrity of our marketplace seriously and will assist in facilitating communication between buyers and sellers where disputes arise.

Sellers who consistently fail to meet their CGA obligations may have their Card Advantage account suspended or terminated.
